Foreword:
Lanset Communications provides for the free flow of information and ideas
over the Internet. The following is our "Terms of Service Agreement"
which all Lanset Members agree to abide by when utilizing our services.
Your violating this Policy may result in the suspension or cancellation
of your Lanset Internet Service. If you disagree with this policy, you
may contact our offices at (877) 652-6738 within fifteen (15) days from
the date your account was started, to cancel the account.
1. Lanset Communications' Acceptable Usage Policy:
The following constitute violations of Lanset's Acceptable Usage Policy:
- Using Lanset's Service for illegal purposes or in support of illegal
activities. Lanset reserves the right to cooperate with legal authorities
and/or injured third parties in the investigation of any suspected
crime or civil wrong.
- Harassing others by 'mail-bombing' or 'news-bombing.' 'Mail-bombing'
constitutes sending more than ten (10) similar mail messages to the
same email address. 'News-bombing' constitutes sending more than 10MB
of data to a newsgroup.
- Sending unsolicited electronic mail (e-mail) messages where the
recipient objects to the content of the message or to the receipt
of the message in general is also prohibited under this Section.
(a) Subscribers acknowledge that they are expressly prohibited from
utilizing Lanset's Service, Lanset's equipment, or any Lanset email
address in connection with the sending of the same or substantially
similar unsolicited email message, whether commercial or not, to a
large number of recipients. This prohibition extends to the sending
of unsolicited mass mailings from another service which in any way
implicates the use of Lanset's Service, Lanset's equipment, or any
Lanset email address(es).
(b) A message is unsolicited if it is posted in violation of a USENET
or newsgroup charter and/or if it is sent to a recipient who has not
requested or invited the message. For purposes of this provision,
merely making one's email address accessible to the public shall not
constitute a request or invitation to receive messages.
(c) Subscriber specifically agrees that he/she/it will not utilize
Lanset's Service, Lanset's equipment, or any Lanset email address
in connection with the transmission of the same or substantially similar
unsolicited message to 50 or more recipients or 15 or more newsgroups
in a single day. A Subscriber responsible for these acts may be terminated
at Lanset's discretion and a fine may be assessed. Lanset at its sole
discretion shall determine whether such a violation was unintentional
or willful. Fines assessed by Lanset and paid by the member under
this provision shall not prevent Lanset from seeking to obtain other
legal remedies against the member, including other damages or an injunction.
- Revealing your account password to others or allowing use of your
account by others (other than authorized users in your household).
At no time may there be simultaneous use of the same username and
password combination.
- Use of software or any device that would allow your account to
stay logged on while you are not actively using Lanset's Service or
use the account for the purpose of operating a server of any type.
(See Section 2)
- Posting articles to any USENET or other newsgroup, mailing list
or similar forum which are off-topic according to the charter or other
public statement of the forum.
- Engaging in any of the above activities using the service of another
provider but channeling such activities through an Lanset account
or re-mailer, or using an Lanset account as a mail drop for responses.
2. Unlimited Service
Subscriber acknowledges that Lanset's Service is intended for periodic,
active use of email, user newsgroups, file transfers via FTP, Internet
chat, Internet games, and browsing the World Wide Web. Subscriber further
agrees not to use the Service on a standby or inactive basis in order
to maintain a connection. Pinging is expressly prohibited. Accordingly,
Lanset maintains the right to terminate Subscriber's connection following
any extended period of inactivity as determined by Lanset.
3. Liability
Lanset has no practical ability to restrict all conduct, communications,
or content which might violate this Policy prior to its transmission
on Lanset's systems, nor can Lanset ensure prompt removal of any such
communications or content after transmission or posting. Accordingly,
Lanset does not assume liability to Subscribers or others for any failure
to enforce the terms of this Policy.
You, the customer, are responsible for all charges associated with connecting
to Lanset Communications Internet services. YOU AGREE THAT ANY TELEPHONE
CHARGES INCURRED ARE YOUR RESPONSIBILITY. DEPENDING ON YOUR PARTICULAR
LOCATION, THE NEAREST ACCESS NUMBER MAY NOT BE A LOCAL PHONE CALL AND
YOU MAY BE SUBJECT TO LONG DISTANCE CHARGES. You should check with your
local phone company to determine whether any specific access number
is a local call.
Our cumulative liability to you for any and all claims relating to the
Service shall not exceed the total amount of the Service fees you have
paid to us within the prior year. UNDER NO CIRCUMSTANCES ARE WE OR OUR
EMPLOYEES, AFFILIATES, OR CONTRACTORS LIABLE FOR ANY INDIRECT, INCIDENTAL,
EXEMPLARY, MULTIPLE, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES THAT
RESULT IN ANY WAY FROM ANY USE OF YOUR ACCOUNT OR THE SERVICE.
Subscribers expressly agree that exclusive jurisdiction for any claim
or dispute resides in the courts of the county of Sacramento in the
State of California. Member further agrees and expressly consents to
the exercise of personal jurisdiction in the State of California in
connection with any dispute or claim involving Lanset Communications.
Any legal dispute or claim against Lanset Communications shall be addressed
in the county of Sacramento in the State of California.
Subscription and Cancellation Policy
Subscribers acknowledge that all accounts are on a subscription basis
and will automatically renew at the end of each period, unless we are
otherwise notified. To make any changes to your account status, contact
our sales department at (877) 652-6738, at least five days prior to the
renewal date on the account.
There are no refunds on yearly and quarterly accounts. Monthly accounts are
closed at the end of the month. Any amounts paid for the month in which you
cancel and any fee(s) for any expired period before termination are
non-refundable. The account activation fee and any other one-time fees are
not refundable.
Cancellations and other account modifications must be made by telephone
to our sales department. Requests made by email, or any other such method
will not be accepted.
4. Revisions to this Policy
Lanset reserves the right to amend, alter, or modify the Policy at any
time and in any manner. Any amendment, alteration, or modification is
effective thirty (30) days after posting on Lanset's Web site (www.lanset.net).
